Property Dispute leads to Robbery and Battery

On Friday July 7, 2017 at approximately 4:15 PM Sheriff Scott Montgomery responded to #7 Jeffery Lane to an unknown disturbance. Upon arrival Montgomery met with the victim, 57 year old Darann Hart. Hart stated that he had been beaten up by 26 year old Caleb Chwalinski of Houston. Hart had a laceration to his forehead and a cut to the back of his head. Hart stated that Chwalinski attacked him and stole 40-50 dollars and his debit card from him.

Chwalinski took the debit card to Tackett and told her to go get electricity turned on. Montgomery had contacted Tackett and she returned the debit card to him, but stated that she nothing about any money.

Sheriff Montgomery stated, “This incident started over a dispute of the property, in which the victim Darann Hart and his girlfriend Twanna Tackett share. Ms. Tackett has lived here for 11 years and Hart has lived here for about 1½ years and Tackett wants Hart gone from the property. Chwalinski took matters in his own hands, when they should have done it the legal way”.

Sheriff Montgomery filed an affidavit for Chwalinski’s arrest for Robbery, a class B Felony and Battery 3rd Degree, a class A Misdemeanor. Chwalinski turned himself in after learning he had a warrant, he denied taking any money, but admitted to taking the debit card because Hart wouldn’t help Tackett with any bills.

Chwalinski is being held in the Perry County Detention Center awaiting a bond hearing.
